Je-li však spolkový život v souladu s Tocquevillovým míněním nejlepší zárukou, že se občané demokracie nestanou posledními lidmi, pak v soudobých společnostech čelí neustálému ohrožení. Možnost smysluplného společenství nesnižují vnější síly, ale samotné principy svobody a rovnosti, jež jsou jeho základem a v dnešním světě se stále více prosazují.
Podle anglosaské verze liberální teorie, která stála u zrodu Spojených států, mají lidé dokonalá práva, ale nikoli povinnosti ke svým společenstvím. Tyto povinnosti jsou nedokonalé, protože se odvozují od práv; společenství existuje jen proto, aby chránilo práva. Morální závazky jsou proto výhradně smluvní. Nestojí za nimi Bůh, strach o věčný život nebo přirozený řád vesmíru, ale spíše soukromý zájem smluvní strany na dodržení smlouvy s ostatními.
