This capability hinges on the subject's ability to distinguish between ethically positive and negative outcomes. Furthermore, the moral subject must possess the sensitivity to recognize the tension between the "given" reality and the normative "ought," or what should be. Without this capacity for discernment and reflection, the concept of moral decision-making remains inapplicable. The text highlights that the essence of a moral situation lies in the subject's awareness and their internal processing of values. Consequently, the structure of an ethical situation is fundamentally defined by the presence of a conscious agent who navigates the boundary between existing facts and moral imperatives through their perception and judgment.

O situaci vůbec můžeme mluvit jen v souvislosti s něčím resp. s někým, pro něhož to je právě jeho situace – je to subjekt situace. Není žádné situace bez subjektu, k němuž je vztažena a který se vztahuje k ní. (Pokusy o jakousi „objektivaci“ situace mohou mít omezený smysl jen v případě, kdy jde o subjekty postrádající schopnost se k situaci vztáhnout ve svém vědomí, event. myšlení.) O etické resp. morální situaci můžeme tedy mluvit (a uvažovat) jen v souvislosti s příslušným etickým resp. morálním subjektem (tj. subjektem, schopným vědomého etického resp. morálního rozhodování). Na druhé straně o etickém resp. morálním rozhodování nelze hovořit tam, kde sice o nějaký subjekt jde, ale o takový, který není podobného rozhodování schopen, tj. který především nedokáže (ve vědomí resp. v myšlení) dost rozlišit mezi tím, co je eticky (morálně, mravně) pozitivní a co v témž ohledu negativní – tedy který není vůči rozdílu mezi pouze „daným“ a tím, co „má být“ dostatečně vnímavý a citlivý.
